Terms of Service

These Terms of Service (“Terms”) govern your use of ARC-24: Multitrack Groovebox (the “App”), developed and published by Daelan Wood (“we,” “us,” or “the developer”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, in accordance with Apple’s Standard End User License Agreement (EULA) and any usage rules set out in the Apple Media Services Terms and Conditions. This license is for your personal, non-commercial use unless otherwise agreed in writing.

2. Trial and Purchases

The App is offered with a 7-day free trial. Following the trial period, continued access to the App’s full functionality requires a one-time in-app purchase (“unlock”). This is a single, non-recurring purchase — the App does not use subscriptions, and you will not be charged on a recurring basis.

All purchases are processed through Apple’s App Store and are subject to Apple’s own terms and refund policies. We do not have the ability to directly process refunds; refund requests should be directed to Apple.

3. Your Content

Songs, samples, recordings, and other content you create or import within the App (“Your Content”) remain your property. You are solely responsible for Your Content, including ensuring you have the necessary rights to any samples or audio you import into the App.

If you enable iCloud sync, Your Content is stored via Apple’s iCloud service and subject to Apple’s iCloud terms. We do not access, host, or have visibility into Your Content stored via iCloud.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by applicable law
• Use the App for any unlawful purpose
• Attempt to circumvent the App’s purchase or licensing mechanisms

5. Intellectual Property

The App, including its design, code, sound engine, bundled drum kits, and branding, is the property of Daelan Wood and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or underlying source code.

6. No Warranty

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or compatible with all devices or iOS versions.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of or inability to use the App, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the App will not exceed the amount you paid for the App.

8. Termination

We may suspend or terminate your access to the App’s functionality if you violate these Terms. You may stop using the App at any time by deleting it from your device.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of Alberta, Canada, without regard to conflict of law principles.
